These Terms of Use ("Terms") govern your access to and use of the SDASMS platform, a cloud-based messaging and marketing platform designed to support digital evangelism, ministry communication, outreach campaigns, notifications, and related messaging services. SDASMS enables ministries, churches, faith-based organizations, businesses, and individuals to communicate effectively through SMS and other supported messaging channels.

By creating an account, accessing, or using SDASMS, you agree to these Terms.


1. Definitions

"SDASMS", "we", "our", or "us" refers to SDASMS and its operators.

"User", "you", or "your" refers to any individual or organization using the platform.

"Services" means all messaging, marketing, communication, API, and related services provided by SDASMS.


2. Eligibility

You must:

  • Be at least 18 years old or have legal authority to represent an organization.
  • Provide accurate registration information.
  • Maintain the security of your account credentials.
  • Be legally permitted to use messaging services in your jurisdiction.

You are responsible for all activities conducted under your account.


3. Acceptable Use

You agree to use SDASMS only for lawful purposes.

You shall NOT use the platform to:

  • Send spam or unsolicited messages.
  • Distribute fraudulent, deceptive, or misleading content.
  • Promote illegal activities.
  • Transmit malware, viruses, or harmful code.
  • Harass, threaten, or abuse individuals.
  • Violate privacy, intellectual property, or other legal rights.
  • Circumvent carrier, network, or regulatory requirements.
  • Send content that promotes hatred, violence, or discrimination.

For ministry and evangelism campaigns, users are encouraged to communicate respectfully and obtain appropriate consent where required.


4. Consent and Recipient Responsibility

You are solely responsible for ensuring that:

  • Recipients have provided consent where required by law.
  • Contact lists are obtained legally.
  • Opt-out requests are honored promptly.
  • Messages comply with applicable telecommunications and privacy regulations.

SDASMS may suspend accounts that generate excessive complaints or violate messaging regulations.


5. Account Registration

To access certain services, you must create an account.

You agree to:

  • Provide accurate information.
  • Keep your account information updated.
  • Maintain the confidentiality of your password.
  • Notify us immediately of unauthorized account access.

SDASMS is not liable for losses resulting from unauthorized use of your account.


6. Messaging Credits and Payments

Where applicable:

  • Messaging credits must be purchased before use.
  • All payments are final unless otherwise required by law.
  • Unused credits may expire according to the applicable pricing plan.
  • Prices may change with prior notice.

Network operator fees and taxes may apply depending on the destination country.


7. Service Availability

While SDASMS strives to provide reliable messaging services across Africa and other supported regions, delivery depends on mobile network operators, internet connectivity, and third-party infrastructure.

We do not guarantee:

  • Continuous service availability.
  • Delivery speed.
  • Delivery to every recipient.
  • Error-free operation.

Temporary interruptions may occur due to maintenance, upgrades, or circumstances beyond our control.


8. Content Ownership

You retain ownership of the content you submit through SDASMS.

By using the Services, you grant SDASMS a limited license to process, transmit, store, and deliver your content solely for providing the Services.

You represent that you have all necessary rights to the content you send.


9. Intellectual Property

All platform software, branding, trademarks, designs, and proprietary technology remain the property of SDASMS.

You may not:

  • Copy or reproduce the platform.
  • Reverse engineer the software.
  • Modify or create derivative works.
  • Use SDASMS branding without written permission.

10. Privacy

Your use of SDASMS is also governed by our Privacy Policy.

We implement reasonable security measures to protect user information. However, no electronic transmission or storage method can be guaranteed completely secure.


11. Suspension and Termination

SDASMS may suspend or terminate accounts that:

  • Violate these Terms.
  • Engage in fraudulent activities.
  • Generate excessive complaints.
  • Abuse platform resources.
  • Create legal or regulatory risks.

We may remove content or restrict access without prior notice where necessary.


12. Limitation of Liability

To the maximum extent permitted by law, SDASMS shall not be liable for:

  • Lost profits.
  • Lost data.
  • Business interruption.
  • Indirect or consequential damages.
  • Message delivery failures caused by network operators or third parties.

Our total liability shall not exceed the amount paid by you for the Services during the preceding three (3) months.


13. Indemnification

You agree to defend, indemnify, and hold harmless SDASMS, its officers, employees, and partners from claims arising from:

  • Your use of the Services.
  • Your content.
  • Violations of law.
  • Violations of these Terms.

14. Changes to the Terms

We may update these Terms periodically.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.


15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Tanzania.
